AI-powered support chat in a B2B context
We use an AI-powered support chat to efficiently handle requests from our business customers and document support processes.
3.1 Division of roles
- Insofar as we provide support for our own services and process personal data of our contacts in the process, we act as controllers .
- Insofar as we process personal data on behalf of a business customer (e.g., when the business customer transmits data of its end users to us via our platform and commissions processing in a support context), we act as a Data Processor ; in this case, the Data Processing Agreement (DPA) concluded with the business customer applies.
3.2 Data, Purpose, Legal Basis
The data categories, purpose, and legal bases listed under sections 2.1–2.3 apply accordingly. In the case of data processing, processing is carried out on the basis of the data processing agreement and the instructions of the business customer.
3.3 Sub-processors
We may use sub-processors (e.g., Chatbase, AI modeling services, hosting providers). Chatbase provides DPA/sub-processor information for this purpose.
For OpenAI, business data is not used for training by default, except with an opt-in.
3.4 Transfer to third countries, storage period, data subject rights
Third-country transfers and storage periods comply with the principles described in sections 2.5–2.6. Data subject rights must be asserted against the controller, depending on the roles involved (in the case of data processing, typically against the business customer; we provide support in accordance with the data processing agreement).
