AI Terms of Use (“AI Terms and Conditions”) of Fitness Nation GmbH – Smart Coaching (Nutrition, Training, Balance)

1. Provider, Scope of Application
The provider of the AI functions is Fitness Nation GmbH , Bergstr. 18, 59394 Nordkirchen, Germany (“Provider”).
These AI terms and conditions govern the use of the AI-based coaching functions ("Smart Coaching") via the provider's app .
The general terms of use of the app [Link/Name] also apply . In case of conflict, these AI terms and conditions for AI functions take precedence.
2. Subject of the contract
Smart Coaching provides AI-supported content, suggestions and structural aids for nutrition , training and balance/everyday life (e.g. routines, planning suggestions, motivation, explanations, reflection questions).
The content is automatically generated by AI and is not individually reviewed by medical professionals.
3. Important note: This is not a substitute for medical advice.
Smart Coaching is not a medical, therapy or healing treatment offer and does not replace a medical diagnosis or treatment.
In case of illness, discomfort, pregnancy, medication use, eating disorders, cardiovascular problems or other risks, recommendations should be critically reviewed before implementation and medical advice should be sought if necessary.
In case of acute symptoms or emergencies, medical help should be sought immediately via the usual emergency numbers.
4. Terms of Use, Nickname Requirement, Prohibition of Identifying Information
Users in Smart Coaching are not permitted to enter any data that allows for direct identification. Only a nickname may be used.
In particular, the following information must not be entered: first and last name, address, exact location data, telephone number, email address, ID/customer numbers, payment details, names of third parties or other unique identifiers.
The provider may technically block, shorten or remove content to the extent necessary to comply with these rules, for security or legal compliance.
5. Entries, special categories of personal data
Users are responsible for deciding what content they enter. Users should not upload documents/screenshots that contain personal data (e.g., medical reports with names/addresses).
Insofar as users enter health data (e.g., weight, complaints, diagnoses), this may constitute special categories of personal data within the meaning of Art. 9 GDPR; details are governed by the data protection regulations.
6. AI specifics: Limits, quality, responsibility
AI systems can produce incomplete, misleading, or erroneous results. Users are responsible for independently reviewing suggestions before implementation.
The provider does not guarantee any specific outcome (e.g., weight loss, performance improvement, stress reduction).
7. Contract duration, presale, renewal, termination
Smart Coaching is offered as a presale contract with a term of 1 month , 2 months or 6 months at the prices displayed at the time of conclusion.
Automatic renewal: The presale is automatically extended for the originally selected term unless cancelled at least 3 days before the end of the term .
No probationary period.
Cancellations are possible via [in-app cancellation method / account area / email address] . The decisive factor is the timely receipt of the cancellation notice.
8. Right of withdrawal (consumer)
Consumers have a statutory right of withdrawal. The cancellation policy and the model cancellation form can be found at [Link] .
Premature expiry of the right of withdrawal for digital content/services:
If the user requests that the provider begin performance before the end of the withdrawal period (e.g., by activating/starting the app service ) and the user simultaneously confirms that they thereby lose their right of withdrawal, the right of withdrawal expires upon commencement of performance.
(Important: To ensure legal compliance, you need a clear checkbox and confirmation in the app in accordance with Section 356 Paragraph 5 of the German Civil Code (BGB).)
9. Availability, changes, updates
The provider strives for high availability, but does not guarantee uninterrupted use.
The provider may further develop, change or adapt functions, provided that this is reasonable for the user and that essential service components are not unreasonably eliminated.
10. Unauthorized use
Specifically prohibited are illegal content, hate speech/threats, glorification of violence, dangerous instructions for action, circumvention of protection mechanisms, and the entry of third-party data without authorization.
11. Liability
Unlimited liability in cases of intent, gross negligence, injury to life, body or health, and under mandatory law.
In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations and only to the extent of the foreseeable damage typical for this type of contract.
No liability is accepted for damages resulting from the implementation of AI suggestions without independent review or in the event of disregard for warning notices.
12. Jurisdiction, Applicable Law, Final Provisions
German law applies.
The place of jurisdiction, insofar as permissible, is Coesfeld .
Should individual clauses be invalid, the remainder of the contract shall remain valid.
